Legal information - Our Terms and Conditions (Acceptance of order is acceptance of our terms and conditions.

All contracts between Gloucestershire Granite and Marble * and the person (customer) who accepts the quotation from Gloucestershire Granite and Marble or the sales of the goods or whose order of the goods is accepted by Gloucestershire Granite and Marble shall be governed exclusively by these terms and conditions of sale and no variation or addition to these conditions shall be binding unless agreed in writing by the authorised representatives of the customer and Gloucestershire Granite and Marble.

1.0 General Terms

1.1  Customers are responsible for obtaining any planning permission or consent for any work to be carried out. Gloucestershire Granite and Marble cannot advise on working with electricity, gas or water and therefore accept no liability.

1.2  In line with English law, Gloucestershire Granite and Marble shall be under no liability for any loss, damage or injury arising as a consequence of advice provided.

1.3  English law shall govern these terms and conditions and any contract between Gloucestershire Granite and Marble and any other party. If any part of these terms and conditions is found to be unenforceable as a matter of law, all other parts of these terms and conditions shall not be affected and shall remain in force.

1.4  Gloucestershire Granite and Marble reserves the right to change these terms and conditions from time to time and when they affect current Customer orders Gloucestershire Granite and Marble will advise the Customer accordingly in sufficient time to allow the Customer to amend or terminate the contract by written notice.

1.5  Either party may immediately terminate the contract by written notice if the other becomes insolvent or is deemed to be insolvent within the meaning of section 123 of the insolvency act 1986

1.6  Any notice to be given by either party to the other under these conditions shall be in writing addressed to that other party at its registered office, principle place of business or where a person is dealing as a consumer at such address as may at the relevant time have been notified pursuant to this provision to the party giving the notice.

1.7  No waiver by Gloucestershire Granite and Marble or any breach of the contract by the customer shall be considered as a waiver of any subsequently breach of the same or any other provision.

 

2.0 Descriptions and Images
2.1
Gloucestershire Granite and Marble cannot guarantee that the appearance or description and/or colour of products of natural stone shown in any of our advertising or sales material will exactly match the appearance and/or colour of the actual products.
2.2 All natural materials supplied are subject to their natural markings, veining, variations in colour, cracks and vents.
2.3 Descriptions of materials offered are for guidance only and in no way imply suitability.
2.4 All dimensions quoted are nominal and no liability is accepted for reasonable variations.

 

3.0 Prices and Payment
3.1 The price of goods is the price stated in
Gloucestershire Granite and Marble order acknowledgment, unless otherwise stipulated in writing by Gloucestershire Granite and Marble . Quotes are only approximate and may differ to total price of the order acknowledgment following templating of worktops (If the measurements originally supplied by the customer vary.
3.2 The price quoted is usually inclusive of VAT unless stated otherwise in the Quotation.
3.3 Trade Customers with an account with
Gloucestershire Granite and Marble will be required to make payment of a 30% (of total price) deposit upon ordering. The remaining balance is to then be paid at the time the goods leave Gloucestershire Granite and Marble Granites premises or earlier if delivery is delayed by the customer/on their behalf. The 70% balance payment is payable within thirty days of the invoice date. Acceptance of trade accounts is subject to a credit check and credit scoring process.
3.4 Domestic customers are required to make a 50% deposit payment and a final payment upon completion of installation. If the installation is delayed by other parties (Not
Gloucestershire Granite and Marble ) Gloucestershire Granite and Marble reserves the right to ask for the remaining 50% balance.

3.5 When purchasing Tiles Gloucestershire Granite and Marble will ask for 80% in advance of delivery with the remaining 20% payable within 30 Days of goods receipt.

3.6 Gloucestershire Granite and Marble reserves the right to charge interest and debt recovery costs after 30 days from the invoice date. Interest will be charged at the Bank of England’s base rate plus 8%.

 

4.0 Orders and Contracts
4.1
Gloucestershire Granite and Marble accepts orders subject to availability of goods.
4.2 Orders taken by telephone will not be accepted unless confirmed in writing or e-mail.
4,3 On receipt of an order from the customer,
Gloucestershire Granite and Marble will issue an order acknowledgment that will confirm the relevant specifications, details and price. It is the responsibility of the customer to ensure that this order acknowledgment is correct. This must then be signed by the customer as confirmation of their approval and returned to Gloucestershire Granite and Marble.
4.4
Gloucestershire Granite and Marble shall be under no liability in respect of any defect in the goods arising from any drawing, design, specification or template supplied by or on behalf of the customer.
4.5 No guarantee will be given for an exact match due to the nature of the product when asked to supply more than one piece of natural stone.
4.6 Tolerance of +/- 2mm on the thickness of the granite
and 3mm on cut out if polished.

 

5.0 Delivery
5.1 Goods shall be delivered by a method of transport
Gloucestershire Granite and Marble considers suitable to the address requested by the customer.
5.2 Delivery of goods shall be considered complete by
Gloucestershire Granite and Marble upon physical delivery by Gloucestershire Granite and Marble , collection by the customer or on their behalf, or authorised agent of Gloucestershire Granite and Marble at which point Gloucestershire Granite and Marble is no longer liable.
5.3 Goods must be inspected and signed for by the customer or on their behalf upon delivery or collection. At this time, the customer shall be deemed to have accepted and not entitled to reject goods.
5.4
Gloucestershire Granite and Marble will do all that is reasonably possible to meet given delivery dates however dates are only approximate. Gloucestershire Granite and Marble shall not be liable for any delay in delivery of the goods howsoever caused. In such circumstances Gloucestershire Granite and Marble will contact the customer to agree an alternative date. The customer will do all that is reasonably possible to enable delivery to take place on the given date. In unforeseen circumstances beyond the reasonable control of the customer, the customer will contact Gloucestershire Granite and Marble to agree an alternative date.
5.5 If the customer refuses delivery or collection of goods within
Gloucestershire Granite and Marble 's normal working hours (9am to 5pm)               

5.6 Gloucestershire Granite and Marble may store goods at the customer’s risk.

 

6.0 Risk and Ownership
6.1 As soon as delivery or collection is complete, the customer will be responsible for the safekeeping of the goods and
Gloucestershire Granite and Marble will not be liable for damage or fault arising from incorrect storage. If the customer fails to take delivery of goods at the time tendered by Gloucestershire Granite and Marble , risk of damage or loss shall pass to the customer.
6.2  If upon delivery, payment has not been received by
Gloucestershire Granite and Marble in full, ownership of the goods shall remain with Gloucestershire Granite and Marble and therefore the customer is required to keep goods in the same condition in which they were delivered or collected.
6.3  Until such time as the property of the goods passes to the customer,
Gloucestershire Granite and Marble shall be entitled at any time to require the customer to deliver the goods to Gloucestershire Granite and Marble and if the customer fails to do so forthwith, to enter upon any premises of the customer or any third party where the goods are stored and repossess the goods. If the customer shall have re-sold the goods, the proceeds of such sale shall be held by the customer as trustee for and to the account of Gloucestershire Granite and Marble

 

7.0 Returns Policy
7.1 Gloucestershire Granite and Marble
shall be under no liability in respect of any defect in the goods arising from any drawing, design, specification or template supplied by or on behalf of the customer.
7.2
Gloucestershire Granite and Marble shall be under no liability in respect of any defect arising from fair wear and tear, willful damage, negligence, abnormal working conditions, failure to follow Gloucestershire Granite and Marble instructions (whether oral or written), misuse, alteration or repair of the goods without Gloucestershire Granite and Marble's approval.
7.3  Goods which are made to measure, cut or altered to meet the requirements of the customer cannot be exchanged or refunded, unless they are faulty.
7.4 Where any valid claim in respect of the goods which is based on any defect in the quality or condition of the goods is notified to
Gloucestershire Granite and Marble in accordance with these terms Gloucestershire Granite and Marble shall be entitled to offer repair, exchange or refund the customer the price of the goods (or a proportionate part of the price), but Gloucestershire Granite and Marble shall have no further liability.
7.5 Any claim by the customer which is based on any defect in the quality/condition of the goods shall (whether or not delivery is refused by the customer) be notified to
Gloucestershire Granite and Marble within seven days from the date of delivery. If delivery is not refused, and the customer does not notify Gloucestershire Granite & Marble accordingly, Gloucestershire Granite shall have no liability for such defect or failure.
7.6 Returned goods must be unused, as new, in saleable condition and in original packaging.

 

8.0 Installation

8.1 We strongly advise all customers fitting granite work worktops to confirm with their kitchen manufacturer that their units will support the weight of granite worktops. (Solid granite and solid stone weighs 90kgs per square metre). We cannot accept responsibility for damage to units that has been caused by the weight of the worktops we have fitted.

8.2 Any void spaces for appliances should have a baton put on the wall at the back to support the back of the granite, quartz and stone. Batons are fitted by others, NOT by us..

8.3 All worktops (temporary or laminate) should be removed and hobs/ sinks/ taps removed and
disconnected ready for the granite
to be placed on top. WE ARE NOT plumbers, gas engineers or electricians are not therefore not authorised to touch utilities.

8.4 Under mounted sinks should be supported with batons or shelves to take the weight of the sink
when full of water.
Batons and shelves to be fitted by others, NOT by Gloucestershire Granite and Marble .

8.5 All cupboards should be firm and screwed to each other as well as the wall.

8.6 You or your authorised representative must be present to walk the templaters through your requirements when they first arrive. ALL CUPBOARDS MUST BE CLEARED and old worktops removed PRIOR to templating. You will be required to sign off that the templates meet your requirements and no claim will be accepted subsequently should you change your mind after fitting.
